Within the United States, "hazardous materials" are defined and regulated by the Department of Transportation. The requirements for safe, secure transportation and handling of hazardous materials are found in Title 49, Code of Federal Regulations, usually referred to as 49 CFR. The Code must be followed for identifying, describing, packaging, handling, and transporting these materials, for marking and labeling packages, and for placarding transport units to communicate the hazards.

The United States Environmental Protection Agency regulates the storage, transportation, and treatment of hazardous wastes in the United States and has published regulations in Title 40 of the Code of Federal Regulations. All hazardous wastes when transported are classified as hazardous materials under the 49 CFR regulations.
